Anlin Window Systems ("Anlin"), subject to the terms, conditions and limitations set forth below, warrants Anlin vinyl windows, patio doors, and screens to be free from defects in materials or manufacturing.

This warranty is effective for all Anlin Window Systems Vinyl Window and Patio Door products manufactured on or after August 1, 2008 and installed in the 48 contiguous United States.

WHO IS COVERED

This limited warranty applies to the original owner of a single-family residence (including condominiums), or any commercial structure (including business, government, fraternal, religious, and multi-family non-owner occupied structures) in which Anlin windows or patio doors are installed, whether as a part of new construction or as a replacement.

TRANSFER OF WARRANTY

This limited warranty may be transferred by the original owner of a single-family residence (including condominiums), to one subsequent owner of the residence by giving Anlin written notice within 45 days of transfer of the residence, together with a payment of $45, representing a transfer fee. The warranty for an installation in a commercial structure may not be transferred beyond the original owner.

For the original owner of a single-family residence (including condominums):

In the event of a covered defect or accidental glass breakage, replacement parts and skilled labor to repair or replace any component, at Anlin’s option, will be provided at no charge to the original owner for as long as he/she owns the residence. Accidental glass breakage includes tempered and specialty glass, but excludes laminated glass. Should the original style or color product no longer be available, Anlin will, at its discretion, provide a current product of equal or higher quality.

For the first subsequent owner of a single-family residence (including condomnimums):

In the event of a covered defect, or accidental glass breakage, replacement parts and skilled labor to repair or replace any component, at Anlin’s option, will be provided as follows: Replacement parts will be provided to the subsequent owner (see Transfer of Warranty above), for a period of 20 years after the date of manufacture of the covered window, patio door, or screen. Skilled labor to repair or replace any component, at Anlin’s option, will be provided to the subsequent owner for a period of 5 years after the date of manufacture of the covered window, patio door, or screen. Accidental glass breakage includes tempered and specialty glass, but excludes laminated glass. Should the original style or color product no longer be available, Anlin will, at its discretion, provide a current product of equal or higher quality.

For the original owner of a commercial structure (including business, government, fraternal, religious, and multi-family non-owner occupied structures):

In the event of a covered defect, replacement parts and skilled labor to repair or replace any component, at Anlin’s option, will be provided as follows: Replacement parts will be provided to the original owner for a period of 15 years after the date of manufacture of the covered window, patio door, or screen. Skilled labor to repair or replace any component, at Anlin’s option, will be provided to original owner for a period of 5 years after the date of manufacture of the covered window, patio door, or screen. Should the original style or color product no longer be available, Anlin will, at its discretion, provide a current product of equal or higher quality.

EXCLUSIONS FROM COVERAGE

This limited warranty does not cover:

• Damages caused by improper or faulty installation.
• Damages caused by abuse, misuse, vandalism or natural catastrophe.
• Damages caused by paint, solvents, chemicals, after market films/tints, fumes, vapors, mildew, air pollution, normal weathering, or corrosion from a salt-air environment.
• Damages caused by building settlement or structural failures of walls or foundations.
• Damage that occurs before installation is complete.
• Costs associated with scaffolding or lifts.

IMPORTANT ADDITIONAL LIMITATIONS

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER ORAL OR WRITTEN EXPRESS WARRANTIES, LIABILITIES OR OBLIGATIONS OF ANLIN.

NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS SHALL BE EFFECTIVE FOR A PERIOD IN EXCESS OF 1 YEAR FROM THE DATE OF ORIGINAL MANUFACTURE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

IN NO EVENT SHALL ANLIN BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES OF ANY KIND, INCLUDING ANY DAMAGE TO THE BUILDING, ITS CONTENTS OR ANY PERSON THEREIN, RESULTING FROM THE BREACH OF ANY WARRANTY SET FORTH HEREIN. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

NO FIELD REPRESENTATIVE, DISTRIBUTOR OR DEALER OF ANLIN IS AUTHORIZED TO MAKE ANY CHANGE OR MODIFICATION TO THIS LIMITED WARRANTY.

HOW TO MAKE A CLAIM

If you believe that you have a valid claim to make under this limited warranty, you must promptly notify in writing the contractor or builder that installed the window or door in order to provide an opportunity to investigate the claim and examine the product for defects. You must also send a copy of the notice directly to Anlin at the address set forth below. Reasonable access to the window or door for inspection must be provided.
